And In Re : Sri Gopal Chandra Das. ...... petitioner. The present revisional application has been preferred against the order dated 6th September, 2012 passed by the learned Chief Judicial Magistrate, Dakshin Dinajpur, Balurghat in M.R.

Execution Case No. 46 of 2010.

Records reflect that by the said order the learned Magistrate was pleased to issue warrant of arrest against the present petitioner and fixed a subsequent date for appearance and warrant of arrest. The subject matter of the case relates to execution proceedings and there has been a direction by a co-ordinate Bench of this Court by an order dated 17th October, 2012 that the present petitioner should deposit a sum of Rs.18,000/- to the opposite party no.2.

Today when the mater has been taken up none appears on behalf of either of the parties nor this Court has been appraised regarding compliance of the order dated 17th October, 2012. Having regard to the aforesaid, this Court is of the view that no interference is called for at this belated stage. Accordingly, C.R.R. 3660 of 2012 is dismissed. All pending applications, if any, are disposed of. Interim order, if any, is hereby vacated.
