Bhattacharya, learned advocate appearing for the petitioner and Mr. Mukherjee, learned AGP appearing for the State/Respondents. Records reveal that the original application was filed praying for a direction upon the competent authority to consider the petitioner's claim for compassionate appointment. During pendency of the said original application, the Additional Secretary of the concerned department passed an order vide memo no. 400/LAIII/1E-03/2022 dated 31st January, 2023. In view thereof, the learned tribunal correctly observed that the original application has become infructuous. We do not find any infirmity in the said order and as such, the present writ petition is dismissed.

However, this order of dismissal will not prevent the petitioner from challenging the said order dated 31st January, 2023 before the appropriate forum, in accordance with law.
