The writ petition is taken up for consideration in presence of the learned advocates representing the petitioner and respondent nos. 1 and 2. However, other respondents are not represented today.

It has been submitted on behalf of the petitioner that he was placed under suspension and ultimately during pendency of this writ petition said suspension order has been withdrawn and petitioner has been permitted to resume his duty. Therefore, according to the petitioner this writ petition has become infructuous but at the time the grievance has been ventilated on behalf of the petitioner that the amount which was payable to the petitioner during period of suspension was not released.

In view of the aforesaid submission made on behalf of the petitioner the writ petition stands dismissed as infructuous.

However, this order shall not preclude the petitioner to take steps in accordance with law for payment of due which petitioner is entitled to receive.

Application, if any pending, also stands dismissed.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
