The petitioner complains that the private respondent/KPC Medical College is effecting construction, notwithstanding an order of status quo passed by the learned District Judge, South 24Parganas in Title Appeal No.74 of 2022. Counsel for the private respondent submits that the KPC Medical College (defendant in the suit) is not effecting any construction. A third party, one "M/s. Global Care Hospitals" is effecting such construction. They claim to have a lease of the said property from the Kolkata Metropolitan Development Authority and are effecting construction against a plan sanctioned by the Municipality.

The petitioner may take appropriate steps in the pending civil suit in accordance with law.

Accordingly WPA 27569 of 2022 is disposed of. Urgent certified photostat copy of this order, if applied for, shall be given to the parties as expeditiously as possible on compliance with all the necessary formalities.
