Learned advocate appearing for the petitioner submits that petitioner has been implicated in connection with the instant case on the basis of statement of co-accused. The subject matter of the case relates to recovery of 49 bottles of Phensedyl along with 500 pieces of Nitrazepam Tablets. The investigation of the case has already been concluded and according to the petitioner further detention is unwarranted.

Learned advocate for the State has submitted a report. I have considered the report as well as the period of detention of the present petitioner. As the charge sheet has already been submitted and I find that presently four of the

accused persons are absconding, I am not inclined to release the petitioner on bail at this stage.

I direct the learned Special Court to exhaust the process of law, split up the trial and thereafter release the petitioner on bail after the charges are framed by the learned Special Court. With the aforesaid observations CRM (NDPS) 1564 of 2025 is dismissed at this stage by this Court. However, the learned Special Court would abide by the directions passed above.

Report submitted be kept with the record.
