We have perused the record.

The petitioner, resident of 7 No. Haripur Gram Panchayat, Dantan, Block-II, Paschim Medinipur, has filed a petition with the allegation that the respondent Nos.8 to 13, being the Pradhan, Booth President, Dalanetri of Self-Help Group, Anchal President, Nirman Sahayak, Executive Officer, have defalcated and misappropriated the funds of the said Gram Panchayat. In this background, a prayer has been made in the petition to issue a direction to the respondent Nos.2 to 5 to conduct an enquiry in respect of the defalcation of the funds.

Record reflects that the petitioner has already filed a detailed comprehensive representation dated 22.09.2017 addressed to various authorities including the respondent No.2, District Magistrate, Paschim Medinipur. Learned counsel for the State has fairly submitted that the grievance raised by the petitioner can be duly enquired by the respondent No.2.

WPA 28866 of 2017 This petition was filed in the year 2017 and no one is present to prosecute the present petition.

In the facts and circumstances of the case, we dispose of the present petition by directing the respondent No.2 to duly look into the complaint of the petitioner dated 22.09.217 and conduct an enquiry in respect of the allegation made in the said complaint and take an appropriate action in accordance with law against the persons who are found guilty of the misappropriation in the said enquiry.

Let this exercise be completed within a period of three months from the date of receipt of the copy of this order.

Learned counsel for the State is directed to send a copy of this order to the respondent No.2 without any delay.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
