Case No. 120 of 2024 dated 02.07.2024 under Sections 126(2)/118(2)/109(1)/351(3)/3(5)/61(2) of the B.N.S, 2023.

1. Petitioner is in custody for 159 days. Whether injuries are life threatening must be assessed at the appropriate stage of the proceeding. It is submitted investigation is complete and co-accused has been enlarged on regular bail. It is also contended there is no chance of abscondence. He prays for bail.

2. Learned counsel for the State opposes the bail prayer.

3. Considering the materials on record and as the investigation is complete, we are inclined to grant bail to the petitioner.

4. Accordingly, we direct the petitioner namely, Sourav Patra @ Biki @ Vicky, shall be released on bail upon furnishing a bond of Rs.10,000/- with two registered sureties of like amount each, to the satisfaction of the learned Chief Judicial Magistrate, Howrah, subject to condition that the petitioner shall appear before the trial court on each and every date of hearing until further orders and shall not intimidate witnesses and/or tamper with evidence in any manner whatsoever.

5. In the event petitioner fails to appear before the Trial Court without any justifiable cause, the Trial Court shall be at liberty to cancel his bail without any further reference to this Court.
