within the jurisdiction of Bishnupur Police Station relating to Panakua Gram Panchayat.
State has submitted reports enclosing a document that so far as Dag No.56 is concerned, the same belongs to the State of West Bengal while Dag No. 55 belongs to the petitioner. It is an admitted position from the records of the case as well as the reports that some materials may be kept by the Panchayet authorities at the adjoining land.
I direct that so far as Dag No. 55 is concerned for which admittedly there is no dispute regarding the ownership or possession, if any materials have been kept by the Panchayat authorities or any other government authorities, the Inspector-in-Charge, Bishnupur Police Station would direct the concerned Panchayet authorities or the government authorities to remove such materials within a week from the date of communication of this order. With the aforesaid observations, the writ petition being WPA 27948 of 2024 is disposed of. There shall be no order as to costs.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this Court.
Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
