1. The instant revisional application has been filed under Section 528 of the B.N.S.S. has been filed seeking for quashing First Information Report being P.S. Case No. 201 dated September, 12,2025.

It is submitted on behalf of the learned advocate for the petitioner that the private opposite parties lodged a written complaint with the Chatterjeehat Police Station against the present petitioners who are the officers of the HDFC Life Insurance Company Limited. The allegation in the written complaint was that the petitioners persuaded the de-facto complainant to invest certain money in some policies. Later on, the petitioners allegedly diverted the

invested money into Life Insurance Policy forging the signature of the de-facto complainant. On the basis of such written complaint lodged by the private opposite parties a First Information Report was started being Chatterjeehat Police Station Case No. 201 of 2025, the case is still under investigation, the final investigation report is yet to be filed.

3. It is submitted by the learned advocate for the petitioner that the private opposite party/de-facto complainant has already received all invested money. The matter has been settled between the parties and as such the case being Chatterjeehat Police Station Case No. 201 of 2025 should be quashed.

4. Learned advocate for the de-facto complainant/opposite parties appears virtually. He submits that the de-facto complainant has already received invested money. He is no more willing to proceed with the First Information Report which was lodged by the de-facto complainant.

5. A compromise petition has also been handed over to the state in this regard.

6. The copy of the application has been served upon the respondents, learned advocate Mrs. Faria Hossain appears for the State, has made her submissions on behalf of the State.

7. Learned Advocate for the state-respondent files a report which states that, the complainant has made statement that he has amicably resolved this matter concerning Chatterjeehat Police

Station Case No. 201 of 2025 with the HDFC Life Insurance Company Limited.

8. The de-facto complainant has also recorded his statement to such effect under Section 180 of BNSS.

Having heard the submissions made on behalf of the parties and on perusal of materials on record including the report submitted on behalf of the State it appears that originally a case being Chatterjeehat Police Station Case No. 201 of 2025 dated September 12, 2025 under Section 318(4)/316(2)/336(3)/61(2)(b) of BNS was started against the present petitioner. The case was being investigated and in fact it is still under investigation. However, in course of investigation, the de-facto complainant received all his money which he invested as persuaded by the present petitioners. Thereafter, the de-facto complainant has settled the disputes with the officials of the HDFC Life Insurance Company Limited i.e. the present petitioners.

10. Learned advocate for the private opposite parties submitted that the petitioner is no more willing to proceed with this case. A memorandum in this regard was signed by him and handed over to the state.

11. The de-facto complainant also made a statement under Section 180 of BNSS to that effect. The de-facto complainant is no more willing to proceed with the case. Under such circumstances, where no public money is involved and the de-facto complainant/

opposite parties received all his money back and not willing to proceed with this case, a trial, if investigation culminates in a charge-sheet, shall be a futile exercise.

12. Under such circumstances the instant revisional application under Section 528 being CRR 5185 of 2025 is allowed. First Information Report being Chatterjeehat Police Station Case No. 201of 2025 dated September12, 2025 and all consequential proceedings there in shall stand quashed.

13. With the above observation this revisional application being CRR 5185 of 2025 stands disposed of.
