During the course of submission, learned counsel for the petitioner seeks permission to withdraw the present petition with liberty to file appropriate application before the Principal Judge, Family Court, Kolkata on the ground that a sum of Rs. 10,000/- had already been paid to the opposite party/wife.

3. Liberty granted.

4. This petition is dismissed as withdrawn.

5. It is made clear that this Court has not gone into the merits of the case and no expression made herein shall tantamount to be in expression on the merits of the case.
