W.P.A. 27624 of 2022 Mr. Susanta Kr. Rakshit .... For the Petitioner Mr. Supratim Dhar .... For the State The order passed by the District Magistrate, Bankura on 21st October, 2016 is assailed in the writ petition.

The said order is amenable to appeal under Rule 51 of the West Bengal Minor Minerals Concession Rules, 2016. The petitioner seeks to withdraw the writ petition and approach the appropriate appellate forum for redressal of his grievance.

In view of the above, the writ petition being WPA 27624 of 2022 is dismissed for non-prosecution. Liberty is granted to the petitioner to approach the appropriate appellate forum for redressal of his grievance.

In the event the petitioners prefer the statutory appeal within seven days from the date of receipt of certified copy of the order impugned, the appellate authority shall deal with the appeal on merits without dismissing the same on the ground of limitation. There shall however, be no order as to costs.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
