After hearing the learned advocates for the respective parties and upon going through the averments made in the application, this Court is of the considered view that the petitioners were prevented by sufficient cause for not appearing when the writ petition stood dismissed for default on January 15, 2026.
Accordingly, the order dated January 15, 2026 stands recalled.
The writ petition is restored to its original file and number.
CAN 1 of 2026 stands allowed.
Re: WPA 27671 of 2025 Petitioners claim to be the owner of certain plots of land which have been utilised for the purpose of construction of an embankment.
Petitioners submitted a representation dated August 18, 2025 before various authorities including the Special Land Acquisition Collector, South 24 Parganas.
Learned advocate appearing for the petitioners on instruction submits that the petitioners have received compensation in respect of certain plots of land but are yet to receive compensation in respect of other plots which have been mentioned in the said representation.
At this stage learned advocate appearing for the petitioners submits that the fact that the petitioners have received compensation in respect of certain plots of land has not been stated in the said representation. He further submits that certain facts have also not been stated in the said representation. He prays for leave to file a comprehensive representation before the said authority.
Without entering into the merits of the claim made by the petitioners in the representation dated
August 18, 2025, this writ petition stands disposed of giving liberty to the petitioners to submit a comprehensive representation before the Special Land Acquisition Collector, South 24 Parganas.
If a comprehensive representation pursuant to this order is submitted, the Special Land Acquisition Collector, South 24 Parganas shall consider the said representation and dispose of the same by passing a reasoned order after affording an opportunity of hearing to the petitioners or their authorized representative and communicate the reasoned order to the petitioners as expeditiously as possible but positively within a period of four weeks from the date of receipt of a server copy of this order along with a copy of the comprehensive representation permitted to be submitted by this Court.
It is, however, made clear that it will be open to the said respondent authority to call for any document from the petitioners and, if such a request is made, the petitioners shall be obliged to supply all such documents to enable the said respondent authority to arrive at a decision on such representation.
