Mr. Sekhar Barman Mr. Rameshwar Sinha Ms. Debanjana Sen ...for the petitioners Ms. Sukanya Bhattacharya Ms. Jonaki Saha ..for the State Learned counsel appearing on behalf of the petitioners submits as follows. The principal accused is the husband of the petitioner no.1 and the father of the petitioner no.2. He was arrested and he is on bail. He is a civic volunteer.

Learned counsel appearing on behalf of the State strongly opposes the prayer for anticipatory bail. She refers to the injury report and to the statements of the victim as well as neighbours. Considering the above, the other materials available on record and the alleged roles ascribed to each of the present petitioners, while I am inclined to grant anticipatory bail to the petitioner no.1 who is a female member of the family, the application for anticipatory bail of the petitioner no.2 is rejected.

Accordingly, the application for anticipatory bail of the petitioner no.1 (Lalita Das @ Lali Das) is allowed.

In the event of arrest, the petitioner no.1 (Lalita Das @ Lali Das) shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioner no.1 shall not threaten or intimidate the witnesses and shall co-operate with the investigation.

The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
