Mr. Shiv Mangal Singh ...for the petitioner The present revisional application has been preferred praying for expeditious disposal of an application under Order 7 Rule 11 of the CPC filed by the defendants/ petitioners herein.

Considering the nature of relief prayed for, service is dispensed with.

It appears that the application under Order 7 Rule 11 CPC is pending before the Trial Court since 4th November, 2022. The said application is pending in Title Suit No. 740 of 2022 before the learned Additional Civil Judge (Junior Division) 1st Court at Alipore.

Considering the fact that the application which is to be decided prior to proceeding with the suit, the Trial Court is directed to make an endeavor to dispose of the application under Order 7 Rule 11 of the CPC on hearing the parties within three months from the date of this order in accordance with law. Accordingly, CO 4041 of 2024 stands disposed of.

Let a copy of this order be sent to the learned Trial Court for expeditious disposal.
