Learned advocate appearing for the petitioner submits that the subject matter of the case relates to recovery of 1 Kg. of Heroin from a co-accused.

According to the learned advocate, petitioner has been arrested on the basis of statement of the said co-accused and there are no incriminating materials which are collected by the Investigating Agency against the present petitioner, as such he may be released on bail.

Learned advocate for the State opposes the prayer for bail and submits that there were whatsapp messages regarding the quantum of contraband to be received. There are also financial transactions. So far as the electronic data is

concerned, the same has been sent for being retrieved by the specialized agency. One of the accused person is still absconding.

Having considered the merits of the present case, I am of the view that prima facie petitioner has failed to make out a case.

At this stage, CRM (NDPS) 1578 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
