Mr. Saswata Bhattacharyya ...for the petitioner The present revisional application has been preferred praying for expeditious disposal of Misc. Case No. 165 of 2017 in Title Execution Case No. 14740 of 2013 pending before the learned Civil Judge (Junior Division), 2nd Additional Court at Alipore. It is submitted that an execution case was initiated in the year 2013. In the year 2017, a Misc. Case has been filed after a long delay and the said Misc. Case has not been disposed of till date, thus causing severe delay in disposal of the Title Execution Case of the year 2013 thereby prejudicing the petitioner/plaintiff/decree holder.

Considering the nature of relief prayed for, service is dispensed with.

The civil revision is disposed of with the direction that the Trial Court shall make all endeavor to dispose of Misc. Case No. 165 of 2017 within a period of two months from the date of this order without granting any unnecessary adjournment and fixing short dates and then proceed to dispose of the Title Execution Case preferably within a period of six months from the date of this order without granting any adjournment.

Accordingly, CO 4039 of 2024 stands disposed of.

Let a copy of this order be sent to the learned Trial Court for expeditious disposal.
