The petitioner is a septuagenarian lady who has filed an application under Section 127 of the Code of Criminal Procedure praying for revision of maintenance allowance against his son. The said application is still pending for disposal. Though the said application which was registered as Misc. Case No. 321/2019 was fixed for recording evidence, evidence was not recorded by the Trial Court on one reason or other.

Considering the fact that a mother being deprived of her maintenance has filed an application under Section 127 of the Code of Criminal Procedure against her own son, the learned Magistrate is directed to dispose of the application for giving unnecessary

adjournment to either of the parties within three months from the date of communication of this order.
