Petitioner is directed to serve a copy of the revisional application upon Mr. Mirza Firoj Ahmed Begg, learned Advocate who ordinarily appears for the State. His appointment may be regularized by the concerned authorities.

Learned Advocate appearing for the petitioner submits that they have been falsely implicated in number of cases and in this case also they have been falsely implicated.

So far the present case is concerned which relates to Sonarpur P.S. case no. 429 of 2023 I find that only FIR and Charge-sheet has been enclosed and documents under Section 207 of Cr.P.C. are yet to be received by the petitioner. The matter is pending before the learned ACJM, Baruipur, South 24 Parganas. Having considered the stage at which the petitioner approached this Court, I am of the view that the revisional application is prematured. Accordingly the petitioner would be at liberty to take

up the issues canvassed in the present revisional application after receiving documents under Section 207 of Cr.P.C. before the learned trial Court under Section 239 Cr.P.C., if so advised. Learned Magistrate should dispose of such application in accordance with law without being influenced by any observations made by this Court.

With the aforesaid observations CRR 4542 of 2023 is disposed of.

Pending application, if any, is consequently disposed of. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. (Tirthankar Ghosh, J.)
