The instant revisional application has been filed seeking quashing of the F.R case No.12 of 2008 arising out of Haringhata Police Station case No.02 of 20025 dated 04.01.2008. It is submitted by the learned Advocate for the petitioner that the case has been pending since long. This is the case of 2008 and till date no witness has been examined on behalf of the prosecution. It is only on this ground of delay, the petitioner has come up before this Court seeking quashing the entire proceeding. Having heard the learned Advocate for the petitioner has also upon perusal of the materials placed before this Court specifically the copy of the order-sheet annexed with this application, it appears that case is of 2008, record reveals that the case has been fixed for considerable period of time for supply of copies.

But at the same time it also transpires materials on record the petitioner also contributed in delaying the trial. He absconded at least twice. Warrant of arrest had to be issued. Later on the petitioner surrendered before the Court and obtained bail. The order-sheet reveals that the case has been fixed for evidence on August 26, 2022, June 22, 2023, June 10, 2024 and August 26, 2025.

In that facts and circumstances of the case, that the petitioner does not appear to have been able to make out a case justifying quashing of the entire proceeding of GR case No.12 of 2008 pending before learned ACJM, Kalyani, Nadia.

In such circumstances, CRR 5192 of 2025 is dismissed. It is, however, appropriate to request the learned ACJM, Kalyani, Nadia to expedite the trial of GR case No.12 of 2008 and dispose of the said case without granting any unnecessary adjournments to either of the parties. The learned Trial Court shall take all legal steps to secure attendance of the prosecution witness.
