Learned advocate for the petitioner has drawn the attention of this court that the husband is a Divisional Engineer of WBSEDCL earning around Rs.63,000/- per month and the interim maintenance so awarded by the learned Judicial Magistrate, 4th court, Alipore is only Rs.6,000/- per month.

Having considered the findings from the records of the Magistrate itself, I direct that the learned Magistrate will ascertain, if required, and convince himself regarding the earnings of the husband but if it is found that the earning of the husband is Rs.50,000/- then in that case the learned court would at least come to a finding of awarding interim maintenance of one-fourth of the amount of maintenance of the husband.

If an application is filed by the wife communicating the order passed by this court, learned Magistrate would reconsider the amount of interim maintenance so awarded in its order dated 0611-2023 after giving an opportunity to both the parties within a period of two months from the date of the communication of this order.

With the aforesaid observations, the revisional application being CRR 4543 of 2023 is disposed of.
