Mr. Chandi Charan De, who usually appears for the State and is present in Court, is requested to appear for the State respondents in this matter.

His appointment be regularised by the learned Legal Remembrancer.

Heard learned counsels for the parties.

The petitioner submits that the petitioner was granted long term mining lease in 2006. The possession of the land was not handed over to him. Several requests made by the petitioner to the State Authorities

for granting possession of the land in question fell on deaf ears for which the petitioner submitted a representation before the concerned Authority on 22nd March, 2017 which is also not considered by the Authority till date. The petitioner prays for a direction upon the Authority to consider the said representation at the earliest.

Having considered the submissions made on behalf of the parties and material on record, the writ petition is disposed of with a direction upon the 5th respondent to consider and dispose of the representation filed by the petitioner dated 22nd March, within two months from the date of communication of this order after giving reasonable opportunity of hearing to the petitioner, in accordance with law.

W.P.A. 28920 of 2017 is thus disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
