Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and he has been implicated on the basis of the statement of the co-accused from whom 5 kgs 635 grams of heroin was recovered. Learned advocate for the State on the other hand opposes the prayer for bail and submits that there are call data records at the time of commission of alleged offence and there are also attending statements implicating the present petitioner.

Having considered that fact that charge-sheet has been submitted and the charges have not yet been framed, at this stage, I am not inclined to release petitioner on bail. Accordingly, the prayer for bail of the petitioner being CRM (NDPS) 1581 of 2025 is dismissed at this stage.

Petitioner will renew his prayer for bail after the stage of consideration of charges is over.

If required, the learned trial Court would exhaust the process and split up the trial of the case.

All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
