Item No.

SL.19 S.D.

28.1.26 In the High Court at Calcutta Constitutional Writ Jurisdiction Appellate Side.

WPA 27564 of 2025 Musammat Rijia Bibi & Anr.

Vs.

The State of West Bengal & Ors.

Mr. Partha Pratim Roy Mr. Samrat Cchakraborty .... For the Petitioner. Mr. K.J. Yusuf Mr. Sanjay Mukherjee .... For the State. The petitioner alleges that the plots of land of the petitioner being plot nos. 3540, 3541 and 3539 within Mouza Baliara, J.L. No. 63 under the Police Station Namkhana in the District of 24 Parganas(South) was acquired but no compensation has been paid to the petitioner till date.

Pursuant to the order dated January 6, 2026, the report in the form of an affidavit has been filed by the State which was taken on record on January 22, 2026. The said report discloses the declaration made under Section 6 of the Land Acquisition Act, 1894. The list of the awardees and the amount of compensation and the date when such compensation was paid has also been disclosed in the said report. The petitioner alleges that the petitioner has not received any compensation

amount in respect of the aforesaid plots. However, this Court finds that the compensation amount in respect of the plots in question was determined and payment in respect of the same was made to the awardees as mentioned in the said report.

Thus it appears that there is a dispute as to the persons to whom the compensation is payable.

The writ petition being WPA 27564 of 2025 stands disposed of leaving the petitioners free to take appropriate steps in accordance with law. .
