Mr. Sudip Ghosh Chowdhury ...for the petitioner Mr. Sourav Mitra .....for the WBCSSC Mr. Santanu Kumar Mitra .........for the State respondents In terms of the order dated 29th August, 2024 a report in the form of affidavit affirmed on 3rd September, 2024 by the District Inspector of Schools (SE), Purulia is filed today and same is taken on record.

On perusal of the said report, it appears that Chief Medical Officer of Health (CMOH), Purulia vide memo dated 18th August, 2022 requested the Medical Superintendent-cum- Vice Principal, Deben Mahato Government Medical College, Purulia to constitute a Medical Board in terms of memo dated 15th June, 2022 of the District Magistrate, Purulia to verify medical documents as submitted by the petitioner for furnishing views of the Medical Board with regard to health status of wife of the petitioner. pursuant thereto, on 25th August, 2022 wife of

the petitioner namely Sangita Maity attended the Medical Board and on medical examination it was found that she has no gynecological disorder and there is no requirement of movement restriction. Views expressed by the Medical Board as contained in the certificate is annexed at page 13 of the said report.

In view of aforesaid medical report furnished by the Medical Board, this Court does not find flaw in the steps taken by the concerned District Inspector of Schools in not forwarding application of the petitioner to West Bengal Central School Service Commission for transfer on medical ground.

Hence, the writ petition stands dismissed.

There shall be, however, no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertakings.
