WPA 27569 of 2025 (Mosiur Rahaman Sk. vs. State of West Bengal & Ors.) Mr. Abhisekh Halder Omar Faruk Gazi Moidul Islam Kayal .... For the Petitioner Mr. Sirsanya Bandyopadhyay Ms. Tapati Samanta .... For the State Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. It appears from the report that pursuant to the complaint lodged by the petitioner FIR has been registered. Investigation is in progress.

Investigating agency is directed to conduct a fair, proper, unbiased and impartial investigation and take the same to its logical conclusion in accordance with law. Learned counsel for the petitioner submits that the petitioner is not able to enter his house due to threat of local hooligans and his house has been ransacked and looted after the CCTV installed therein has been removed. The petitioner seeks adequate police protection.

Upon consideration of the submission made on behalf of the parties, this Court is inclined to hold that the petitioner shall approach the local police authority and intimate the date and time of his intended entry into his house.

The police authority shall render adequate assistance/protection to the petitioner in order to enable him to enter his house and reside therein peacefully. The police authority shall keep strict vigil over the area in order to

ensure so that no untoward incident takes place and there is no breach of peace and tranquility. The police shall render sufficient and adequate protection to the petitioner as and when sought.

With the aforesaid observations and directions the writ petition is accordingly disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
