Petitioner draws the attention of the court to the decree which has been passed in connection with title suit no. 89/2019.

It has been contended that inspite of the specific declaration and permanent direction for restraining the defendants they have been violating the civil court's order and disturbing the peaceful possession of the petitioner's property. It has also been alleged that the private respondents are raising construction in violation of the civil court's order, learned advocate for the state submits that previously the present petitioner lodged a complaint in respect of

which the criminal case was registered in connection with Baruipur PS Case No. 239/24 and subsequently charge sheet has been submitted before the jurisdictional court.

Mere filing of the charge sheet do not absolve the police authorities from respecting and obeying the order of the civil court.

Accordingly Inspector-in-Charge, Baruipur Police Station would ensure that the directions passed by the civil court are not violated at the instance of the respondents or any of their associates. Police authorities would keep a strict vigil and also see to that no untoward incident crops up because of the inimical relationship existing between the parties.

With the aforesaid observations WPA 27984 of 2024 is disposed of.

Report so submitted be kept with the record.

A copy of the report be handed over to the learned advocate appearing for the petitioner. All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
