Versus

The State of West Bengal & Ors.

Petitioner is aggrieved by the fact that in spite of informing the police authorities, no steps were taken, petitioner has approached the learned Executive Magistrate and is aggrieved by the nature of fencing which has been installed.

State has submitted a report. Report reflects that there is a dispute regarding the land in issue. Police authorities have also drawn up proceedings under section 107/116 of the Cr.P.C. Having considered that at the relevant point of time police authorities took steps and the petitioner complains of maintenance of peace and tranquility at the present date also.

I direct that in case the petitioner faces any inconveniences he shall approach the jurisdictional police station with a fresh complaint. The concerned

police station will consider the same in accordance with law.

With the aforesaid observations WPA 28066 2024 is disposed of.

Report submitted be kept with the record. A copy of the report be handed over to the learned advocate appearing for the petitioner.
