The appeal is directed against the judgment and order dated 4th August, 2015 passed by a Single Bench of this Court in W.P. 10326 (W) of 2015. 2.

The said writ petition was the third round of proceeding taken out by the petitioner and/or his mother. The Single Bench found that the refusal by the Commissioner of School Education to accept the recommendation of the DPSC, Burdwan to appoint the petitioner on compassionate ground cannot be faulted. The Single Bench also found that since the petitioner was under age and in Class-VII at the time when his father died-in-harness, he was ineligible for appointment. The Single Bench thus approved the view of the Commissioner of School Education in memo impugned dated 19th March, 2013.

Learned counsel for the appellant also fairly submits that the writ petition may have become infructuous due to efflux of time.

In that view of the matter, MAT 1733 of 2015 shall stand dismissed as infructuous.

Interim orders, if any, shall stand vacated.

There shall be no order as to costs.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
