Despite service of notice, State is not represented. The writ petitioner complains that he is being restrained by the private respondent's brother from effecting construction over a property. The dispute is purely civil in nature and cannot be entertained by the police. The petitioner may take out appropriate civil proceeding.

This Court notes with anguish that the matter has been listed under the heading "Senior Citizen", which heading specifically reserved for violation of rights under Article 21 of the Constitution of India.

In the above circumstances, the writ petition is disposed of with a warning to the petitioner against such practice in future.

There will be no order as to costs.
