Petitioner is directed to serve a copy of the revisional application upon Mr. Arijit Ganguly, learned advocate, who ordinarily appears on behalf of the State. His appearance may be regularised by the concerned authorities.

Petitioner is the de facto complainant and is aggrieved by the manner in which the investigation is being carried out by omitting the relevant documents.

Petitioner submits that the accused persons being influential are trying to suppress the number of documents which can only be unearthed with the aid of the Investigating Agency. In view of the submission so advanced, I direct that incase an application in the nature of Section 94 of the Code of Criminal Procedure is filed before the learned CMM, Calcutta by the complainant/petitioner, learned CMM, Calcutta would consider the

same in according with law for the ends of justice and dispose of the same within a period of 30 days from the date of filing of the said application. It would not be out place to state that, if required, the de facto complaint/petitioner would seek assistance of the public prosecutor in presenting the application before the learned CMM, Calcutta.

With the aforesaid observations, CRR 4550 of 2023 is disposed of.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
