Learned counsel for the respondent-authorities hands over a copy of a notice dated November 28, 2023 indicating that the impugned tender has since been called off "due to administrative reasons".

As such, the writ petition, it is submitted, has become infructuous. Although agreeing to such proposition, learned counsel for the petitioner contends that the petitioner was L2 bidder in the said tender and reserves the right to challenge the cancellation, if need be.

There is substance in such contention.

However, in any event, since the writ petition has become infructuous, there is no necessity of keeping the matter pending.

Accordingly, WPA No. 26658 of 2023 is disposed of as infructuous with liberty to the petitioner to challenge the cancellation of the impugned tender, if the petitioner so feels necessary, in due process of law.

There will be no order as to costs.

Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
