And In Re :
Prasenjit Sadhukhan ... Petitioner.
Ms. Minoti Gomes, Mr. Pralay Hazra ... For the Petitioner.
Mr. Anwar Hossain, Mr. Ratul Ghosh ... For the State.
Ms. Jeenia Rudra ... For the de facto complainant.
Report submitted by the learned advocate appearing for the State be kept with the record.
Learned advocate appearing for the petitioner submits that the petitioner and the de facto complainant were known to each other, both are married individuals who allegedly entered into a relationship and thereafter on bitter terms arising with the husband of the present petitioner, the instant case was instituted against the petitioner who was taken into custody by the police officials on 21.11.2025. Learned advocate appearing for the de facto complainant opposes the prayer for bail and submits that the investigation is yet to be completed and the petitioner is in custody for about 25 days.
Learned advocate appearing for the State opposes the prayer for bail, produces the case diary and draws the attention of the Court to the statement of the victim recorded under Section 183 of the Bharatiya Nagarik Suraksha Sanhita, 2023 as well as the medical report.
I have considered the factual matrix of the case and is of the view that further detention of the present petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed.
Accordingly, the petitioner viz., Prasenjit Sadhukhan shall be released on bail upon furnishing bond of Rs.20,000/-, with two sureties of Rs.10,000/- each, one of whom must be local, to the satisfaction of the learned Additional Chief Judicial Magistrate, Chandernagore. If on bail, the petitioner shall once in a week meet with the Investigating Officer of the case until and unless modified by the learned Additional Chief Judicial Magistrate, Chandernagore.
Case diary be returned to learned advocate appearing for the State.
The application for bail, being CRM (M) 2607 of 2025, is, thus, disposed of.
