Chakraborty, Mr. Kashinath Bhattacharya, Mr. Ashok Halder, Ms. Anjana Mehebub, Advocate ... for the petitioner Mr. Jahar Lal De, Mr. Supratim Dhar, Advocates ... for the State In this public interest petition the prayer of the petitioner is to issue a direction to the official respondents to establish a medical college at Balurghat in district Dakshin Dinajur. According to the petitioner, all the requisite criteria are fulfilled for setting up a medical college in that area.

When the matter is taken up today, learned counsel for the petitioner has pointed out that the petitioner has already made an application/ representation dated 12.10.2022 before the respondent No.2 (The Principal Secretary, Department of Health and Family Welfare, Government of West Bengal) with a request to set up a medical college in Dakshin Dinajpur, but no action has been taken on the said representation.

Submission of learned counsel for the State is that a policy decision is required to set up a medical college at a particular place. He has fairly submitted

WPA (P) 623 of 2022 that there is no objection in deciding the petitioner's representation in accordance with law.

Hence, we dispose of the present petition by directing the respondent No.2 (The Principal Secretary, Department of Health and Family Welfare, Government of West Bengal) to duly consider the petitioner's representation dated 12.10.2022 and take a decision in accordance with law as expeditiously as possible within a period of three months from the date of receipt of the copy of this order.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
