Allowed that the petitioner is in custody for more than 236 days, other accused persons have been granted bail and the charge-sheet has been submitted under Section 308 as also under Section 304 of the Indian Penal Code along with other Sections.

Learned advocate for the State opposes the prayer for bail and has produced the case diary. Attention of the Court has been drawn to the post-mortem report.

I have perused the statement under Section 161 of the Cr.P.C. in respect of the eyewitnesses who have supported the prosecution case. On an overall assessment of the same, I am of the view that further detention of the petitioner is unwarranted. As

such, the prayer for bail of the petitioner is allowed. Accordingly, the petitioner, namely, Kajal Sk. shall be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Lalbagh, Murshidabad. If on bail, the petitioner shall be physically present on each and every date fixed by the learned trial court and shall not leave the jurisdiction of the district of Murshidabad without the prior permission of the learned trial court. Accordingly, CRM(M) 2608 of 2025 is allowed.
