The said report is attested by the Deputy Magistrate & Deputy Collector, Malda Collectorate, Malda wherefrom it appears that the caste certificate relied upon by the private respondent has been found to be genuine.

In view of the factual enquiry that was conducted to ascertain the genuineness of the caste certificate of the private respondent and as the same has been found to be genuine, accordingly, the allegation of the petitioner that the private respondent contested the election relying upon false caste certificate does not appear to be correct.

The writ petition, accordingly, fails and is hereby dismissed.
