1. By this writ petition filed as a public interest litigation, the petitioner seeks for implementation of the schematic proposal of Check-Dam to be built on Bankai Khal, Srikrishnapur and its renovation/excavation as recommended by the Gram Sabha constituted by the farmers/ electors of Madanpur - I Gram Panchayat under Kalyani Panchayat Samity. In this regard, a representation has been given by the petitioner/association to the Executive Officer & Programme Officer on 5th December, 2020. The copy of the representation has also been forwarded to the Executive Engineer, Agri-Irrigation Division, Krishnanagar, Nadia for information and necessary action.

2. In the light of the above, we direct the 4th and 5th respondents to consider the representation and

make a site inspection and examine as to the feasibility of implementation of the recommendations of the Gram Panchayat as well as the suggestions made by the petitioner/ trust and take appropriate action in accordance with law.

3. This direction shall be complied with within a period of three months from the date of receipt of server copy of this order.

4. With the aforesaid directions, the writ petition is disposed of.

5. No costs.

6. Urgent photostat certified copy of this order, if applied for, be furnished to the parties expeditiously upon compliance of all legal formalities.
