Affidavit-in-opposition filed by the ECL and reply thereto filed by the writ petitioner are kept with the record.

It is not evident either from the affidavit-inopposition or from the writ petition as to when for the first time the petitioner indicated his date of birth as 1964 instead of 1963.

Aadhar Card, PAN Card were not in existence when the petitioner joined the Eastern Coalfields Limited on 29th November, 1982.

The petitioner's identity card, issued by the Tilabani Mine of the Eastern Coalfields Limited, shows that his date of birth is 9th November, 1963. 5.

The petitioner filed the instant writ petition just before superannuation of his service. It is now well-settled that an application for correction of date of birth cannot

be entertained immediately prior to superannuation or at the fag end of a person's career.

In that view of the matter, no relief can be granted to the writ petitioner.

Hence, the writ petition fails and is hereby dismissed.

There shall be no order as to costs.
