Patra Ms. Supriya Dubey ...for the WBCSSC Mr. Arindam Ghosh ...for the State The petitioner has come up with the present writ petition, inter alia, challenging awarding of marks against TET qualification of the petitioner in connection with participation of the petitioner in 1st SLST 2016 History (UP) Bengali Medium. The learned advocate representing the petitioner submits that weightage of TET which has been given to the petitioner is 25.3333. According to the petitioner if the proper procedure would have been followed she is entitled to receive 27.4667.

Matter was heard previously and Dr. Sutanu Kr. Patra, learned Counsel representing the West Bengal Central School Service Commission was directed to obtain instruction with regard to the allegation of the petitioner regarding awarding of TET marks less than what petitioner is entitled to receive. Today, matter is taken up for consideration when the learned advocate

representing the Commission submits that the grievance of the petitioner is found to be justified and on scrutiny afresh it has been detected that the petitioner ought to have been awarded 27.4667 instead of 25.3333 for having TET qualification. In support of such submission made on behalf of the Commission statement of marks awarded to the candidates in tabular form under History (UP) Bengali Medium after personality test is placed before this Court and the same is taken on record. On perusal of such statement of marks awarded to the candidates it appears that petitioner has been ultimately awarded 27.4667 as TET weightage. In view of correction of marks of the petitioner for having TET qualification the aggregate marks of the petitioner has been enhanced from 82.3333 to 84.4667.

Taking into consideration the aggregate marks of the petitioner being 84.4667 the concerned authority of West Bengal Central School Service Commission is directed to take steps accordingly and grant opportunity to the petitioner to participate in the next phase of counseling if it is found that petitioner comes within the zone of consideration. In the event the Commission finds that the counseling is over and there is no scope for holding further counseling in that event appropriate steps shall be taken by the Commission in order to accommodate the petitioner for being selected for the post of assistant teacher in the category under which he has applied for.

With the aforesaid directions, the writ petition stands disposed of.

There shall be no order as to costs.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
