1. The petitioner seeks transfer. Her application was returned by the District Inspector of Schools, Secondary Education, Nadia on the ground that the Utsashree Portal is temporarily suspended.

2. The issue as to whether temporary suspension of the Utsashree Portal will disable a teacher not to apply for transfer has been decided by the Court on December 5, 2024 in the matter of Mithun Roy Vs. The State of West Bengal & Ors. in MAT 1706 of 2024 with CAN 2 of 2024.

3. The instant writ petition is disposed of by granting leave to the petitioner to make application seeking transfer in the prescribed format.

4. If such an application is made, then the head of the institution shall consider the said application and if the prayer of the petitioner is allowed then he/she shall take necessary steps to forward the

application of the petitioner to the concerned District Inspector of Schools in accordance with law at the earliest but positively within a period of eight weeks from the date of communication of this order.

5. The school shall act on the basis of the hard copies of the documents to be forwarded by the petitioner.

6. The District Inspector of Schools shall take consequential necessary steps in the matter at the earliest but positively within a period of eight weeks from the date of receipt of all documents from the school.

7. If the application of the petitioner for transfer is allowed, then necessary consequential steps shall be taken without any further delay.

8. The fate of the petitioner's application shall be made known to the petitioner.

9. The writ petition stands disposed of.

10. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities. (Amrita Sinha, J.)
