During the pendency of this appeal arising out of a final decree, the co-sharers have agreed to settle their disputes amicably and have filed a joint compromise petition disclosing terms of settlement arrived at by and between the parties in the meantime. The terms are lawful and entered into by the parties with a view to put to an end to the controversy amicably.

In view of such submission and the fact that the settlement is in terms of Order 23 Rule 3 of the Code of Civil Procedure, the suit is decreed in terms of the compromise arrived at by and between the parties as fully described and stated in paragraph 9 of the compromise petition.

The department is directed to draw up a final decree in terms of the settlement mentioned in paragraph 9 of the compromise petition.

The appeal and the connected applications are, accordingly, disposed of.
