The petitioner prays for expeditious disposal of the misc. case in connection with Matrimonial Suit No.259 of 2019, which is pending before the learned Additional District Judge, 2nd Court, Baruipur, South 24 Parganas.

It is submitted that an application for maintenance pendente lite is pending. The prayer of the petitioner is innocuous. Neither party stands to lose if a proceeding is disposed of expeditiously. In fact, such expeditious disposal shall enure to the benefit of the parties. Hence, there is no requirement for service of prior notice upon the opposite party.

This revisional application is disposed of by requesting the learned Trial Judge to dispose of the application for maintenance pendente lite within four months from the next date fixed, upon giving adequate opportunity to all the contesting

parties, but without granting any unnecessary adjournment to either of the parties, strictly in accordance with law. If the wife's prayer for maintenance pendente lite is allowed and the petitioner pays the sum as directed by the Court, then the Court shall proceed expeditiously with the matrimonial suit and dispose it of within a reasonable time. In case of default, the suit will remain stayed.

This court has not expressed any opinion either on the merits of the misc. case. The learned court shall proceed independently and in accordance with law.

A copy of the revisional application along with a server copy of this order be served upon the opposite party and/or the learned advocate contesting the matter on behalf of the opposite party in the learned court below, within a week. 6.

Affidavit-of-service to be filed before the Court below.

The revisional application is accordingly disposed of. There shall be no order as to costs.
