Learned counsel for the petitioner submits that the matter is quite old and as such learned counsel is not prepared with full instructions in the matter. Learned counsel appearing for the WBSEDCL submits that in view of a dispute having arisen between the respondent no.6 and the petitioner with regard to giving a new electricity connection to the petitioner, the WBSEDCL wrote to the petitioner asking for a 'Way Leave Permission'.
It is submitted that in view of such dispute, the matter may be sent to the concerned District Magistrate for resolution.
There being substance in the submission of learned counsel for the WBSEDCL, WPA 26568 of 2014 is disposed of by granting liberty to the petitioner, in the
event the new connection has not been given to the petitioner in the meantime, to approach the concerned District Magistrate with the dispute as raised in the present writ petition.
If so approached, the District Magistrate shall decide the same in accordance with law upon giving opportunity of hearing to all concerned, as expeditiously as possible. There will be no order as to costs.
Urgent photostat copies of this order, if applied for, be given to the parties upon compliance of all requisite formalities.
