Learned Advocate appearing for the petitioner submits that the petitioner was falsely implicated. The lady developed a crush on the petitioner. Thereafter, on the refusal of the petitioner to reciprocate the police complaint was lodged. Learned Advocate appearing for the State draws the attention of the Court to the statement of the victim recorded under Section 164 of the Code of Criminal Procedure. The victim in her statement recorded under Section 164 of the Code of Criminal Procedure squarely implicates the petitioner. The petitioner claims himself to be a doctor. The petitioner apparently took advantage of his position.
In reply, learned Advocate appearing for the petitioner submits that the petitioner is not a qualified doctor. Apparently, the petitioner claims himself to be a doctor to the public at large. The de facto complainant went to the petitioner as a patient when the incident occurred. Considering the materials in the case diary, the gravity of the offence and the involvement of the petitioner therein as
transpiring from the materials in the case diary, we are unable to grant anticipatory bail to the petitioner.
Prayer for anticipatory bail of the petitioners is rejected. CRM (A) 5871 of 2022 is disposed of.
