Ms. Faria Hossain, along with Ms. Paramita Sahu, learned Counsels appear on behalf of the State. The instant application is filed under Sections 401 read with Section 482 of the Code of Criminal Procedure, 1973 praying for quashing of proceedings of Hare Street Police Station Case No. 430 of 2009 dated 04.08.2009 under Sections 406/417/420/120B of the Indian Penal Code having corresponding to G.R. Case No. 2066 of 2009 pending in the Court of Chief Metropolitan Magistrate, 5th Court, Calcutta including the Order dated 18.09.2012 taking cognizance of the charge-sheet and issuing warrant of arrest against the present petitioners. On perusal of the petition along with the annexures it appears that there are prima-facie incriminating materials against the petitioners. Therefore, the instant case does not invite invocation and exercise of jurisdiction under Section 401 read with Section 482 of the Code of Criminal Procedure, 1973.

The instant application, accordingly, stands dismissed on merit.
