Based on the written instructions filed by the appellant in the instant criminal appeal stating his unwillingness to proceed with the hearing of the same wherein the Opposite Party was acquitted from the charges framed against him under Section 138 of the Negotiable Instrument Act, 1881.

In such circumstances, the instant criminal appeal is dismissed for non-prosecution.

Copy of this order be communicated to the concerned Trial Court through the department concerned.
