Petitioners are directed to serve a copy of the revisional application upon Mrs. Puspita Saha, learned advocate, who ordinarily appears on behalf of the State. Her appointment may be regularized by the concerned Authorities in due course. The subject matter of challenge relating to continuance of Ghola P.S. Case No. 764 of 2022 dated 27-12-2022. I find that the case was instituted under Sections 341/323/354/506/34 of the Indian Penal Code. Having regard to the time period which has elapsed, i.e., 11 months since the initiation of the investigation it would be too late to interfere with the investigation particularly when there are allegations under Section 354 of the Indian Penal Code.

Learned advocate submits that the petitioner no. 2 happens to be a student who is suffering from the pendency of the present criminal case. In view of the nature of the allegations complained of, I am of the opinion that the Investigating Agency should take efforts so that their report under Section 173 of the Code of Criminal Procedure is filed preferably by three months from the date of communication of this order.

Petitioners would be at liberty to take up their issues with the Investigating Agency or their superior officers if they feel the same to be

necessary.

With the aforesaid observations, the revisional application being CRR 4584 of 2023 is disposed of..
