Mr. Debashis Banerjee .....For the Petitioners Mr. Arijit Ganguly Mr. Sandip Chakraborty .....For the State The revisional application was preferred challenging the charge sheet in relation to Jadavpur Police Station Case No.196 dated 10.04.2008 pending before the learned Judicial Magistrate, 10th Court, Alipore.

Mr. Sandip Chakraborty, learned advocate for the State has submitted a report of the Officer-in-Charge, Jadavpur Police Station which reflects that the trial has already commenced and the next date for evidence is fixed on 8th June, 2022.

Report of the Officer-in-Charge, Jadavpur Police Station submitted before this Court be kept with the records. Having regard to the change of circumstances before the learned Trial Court since the revisional application was pending, I am of the view that no interference can be made by this Court at this stage in

relation to the charge sheet or the F.I.R. when charge has already been framed and the examination of the witnesses have commenced. The petitioners will be at liberty to agitate the points canvassed in the revisional application at the appropriate stage of trial and at the stage of final argument of the case. The learned Trial Court is directed to expedite the progress of the trial on and from 08.06.2022. With the aforesaid observations, C.R.R. 3701 of 2012 is disposed of.

Interim order, if any, is hereby vacated.

All pending connected applications, if any, are consequently disposed of.
