Sushanta @ Susanta Howlader v. State Of West Bengal And ANR
16.12.2025
IN THE HIGH COURT AT CALCUTTA
Item No.11 CRIMINAL MISCELLANEOUS JURISDICTION Ct.No.35 dc.
Rejected C.R.M. (M) 2613 of 2025 In Re : An Application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, filed in connection with Kalyani Police Station Case No. 1050 of 2025 dated 19.10.2025 under Section 64(1) of the Bharatiya Nyaya Sanhita, 2023.
And In Re :
Sushanta @ Susanta Howlader ... Petitioner.
Mr. Shibaji Kumar Das, Ms. Deblina De ... For the Petitioner.
Ms. Shaila Afreen, Mr. Kaustav Banerjee ... For the State.
Learned advocate appearing for the petitioner submits that the petitioner is innocent of the charges and has been falsely implicated in connection with the instant case. As such, petitioner may be released on bail on any stringent condition.
Learned advocate appearing for the State, on the other hand, opposes the prayer for bail, produces the case diary and submits that the investigation of the case is in progress. I have considered the statement of the victim and I am of the view that at this early stage, it would not be fit and proper to release the petitioner on bail. As such, the prayer for bail of the petitioner is rejected.
Report submitted by the learned advocate appearing for the State be kept with the record.
The application for bail, being CRM (M) 2613 of 2025, is, thus, dismissed.
