Das ... for the Petitioner(s) Mr. Joydeep Biswas Mr. Debansu Ghorai ... for the State-respondent(s) Learned advocate for the petitioner submits that the petitioner is similarly situated as the another accused who has been granted bail by this court on 02.12.2025 in CRM (M) 2112 of 2025.
Learned advocate for the State opposes the prayer for bail but is unable to distinguish the locus of the present petitioner with that of the accused who has been granted bail.
Having considered the same, I am inclined to enlarge the petitioner on bail.
Hence, the prayer for bail of the petitioner is Allowed.
Accordingly, the petitioner viz, Tapas @ Tapash Kharati shall be released on bail upon furnishing bond of
Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the learned ACJM, Kalyani.
If on bail, the petitioner shall continue to meet with the Investigating Officer of the case once a week as also as and when called for till the same is waived by the learned court in seisin of the case.
The petitioner shall be physically present on each and every date so fixed by the learned trial court and shall not leave the jurisdiction of the district of Nadia without the leave of the learned trial court.
Accordingly, CRM(M) 2630 of 2025 is allowed.
Pending application(s), if any, is also disposed of. Parties to act on a server copy of this order duly collected from the official website of the Hon'ble High Court, Calcutta.
