1. By the present writ petition, the petitioners have sought for directions to allow them to participate in Teacher Eligibility Test (in short TET) which is to be conducted vide Notification under Memo No.2061/ WBBPE/2025/60R-09/25 dated 15th September, 2025.

2. The petitioners contend that they are all pursuing courses approved by the Rehabilitation Council of India (in short, „RCI‟) for special education as required for appointment to the post of Special Education Teacher in Primary Schools.

3. Mr. Dibyendu Chatterjee, learned Advocate appearing for the petitioners submits that the petitioners are pursuing D.Ed. Special Education and the petitioners have annexed their admit cards which will show that

they are pursuing candidates. He further submits that in Akash Mondal & Ors. v. The State of West Bengal & Ors. (In Re: WPA No.27540 of 2025) the pursuing candidates were allowed to participate in the TET Examination. The present petitioners are similarly circumstanced. He seeks for similar reliefs in favour of the petitioner.

4. Mr. Ratul Biswas, learned Advocate appearing for the West Bengal Board of Primary Education (in short WBBPE) submits that the petitioners are similarly circumstanced.

5. In Akash Mondal (supra), following direction was issued:

"17. Therefore, this Court is of the view that the petitioners having pursuing D.Ed in Special Education courses under the RCI approved Institutes be allowed to participate in the TET examination to be conducted pursuant to Notification dated 15th September, 2025.

18. Accordingly, the West Bengal Board of Primary Education is directed to allow the petitioners in WPA 27540 of 2025; WPA 26497 of 2025 and WPA 26892 of 2025 to submit the application through online/offline mode."

6. In view of the above, the West Bengal Board of Primary Education is directed to allow the petitioners to submit the application through online/offline mode.

7. It is made clear that this order will be restricted to the petitioners of the instant writ petition only, whose prayer for submission of application are allowed.

8. With the above observations and directions, the present writ petition being WPA 27624 of 2025 stands disposed of.

9. Since no affidavits have been called for, the allegation made in the writ petition is deemed to be not admitted.

10. Interim order, if any, stands vacated.

11. All connected applications, if any, stand disposed of.

12. There shall be no order as to costs.

13. All concerned parties shall act in terms of the copy of the order duly downloaded from the official website of this Court.

14. Urgent Photostat certified copy of the order, if applied for, be given to the parties on compliance of all necessary legal formalities.
